These Terms and Conditions ("Terms") constitute a legally binding agreement between you and FindMySwim LLC, a California limited liability company ("FindMySwim," "we," "our," or "us"), governing your access to and use of the FindMySwim platform, including our mobile applications, website at findmyswim.com, and all related services.
By registering, joining the waitlist, booking a lesson, or using any feature of our platform, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
FindMySwim is a two-sided marketplace that connects families who have private swimming pools with independent-contractor swim instructors. FindMySwim does not employ instructors. Instructors are independent contractors who set their own schedules and deliver services under the terms of their Instructor Agreement.
FindMySwim provides the technology platform, payment processing, background screening coordination, GPS verification, skill tracking tools, and quality accountability systems — but is not a swim school, does not provide instruction directly, and does not supervise lessons in real time.
To create an account, you must be at least 18 years of age and legally able to enter into a binding contract. Families creating accounts on behalf of minor children must be the child's parent or legal guardian.
FindMySwim reserves the right to suspend or terminate accounts that violate these Terms, provide false information, or engage in conduct that harms other users or the platform.
Bookings are confirmed when a family selects an instructor, chooses a time, and payment authorization is completed through Stripe. All prices are set by instructors and displayed in the app prior to booking.
FindMySwim collects a platform fee of 20% of the lesson price (17% for Founding Instructors during their first 6 months of active teaching). Families pay the displayed lesson price; the platform fee is deducted from instructor payouts.
Payments are processed securely through Stripe. FindMySwim does not store full payment card numbers. Instructor payouts are issued on a rolling schedule following lesson completion and confirmation.

Refunds are returned to the original payment method within 5–10 business days. Disputes are reviewed by FindMySwim's support team using GPS check-in data, in-app messaging records, and available evidence. FindMySwim's determination is final.
All instructors on the FindMySwim platform must meet and continuously maintain the following standards to remain active:
The Swim Circle feature allows primary account holders to add up to two authorized caregivers to their family account (e.g., a nanny, grandparent, or co-parent).
Authorized caregivers have the same platform permissions as the primary account holder and may book lessons, communicate with instructors in-app, view skill reports, and manage the family schedule.
The primary account holder is financially responsible for all bookings and transactions made by authorized caregivers. Authorized caregivers may be removed from the Swim Circle at any time by the primary account holder. Removal takes effect immediately.
The following communication conduct is prohibited and may result in account suspension or termination:
FindMySwim's in-app messaging records may be reviewed in the event of a complaint or dispute. By using the platform, you consent to this monitoring for the purpose of enforcing platform rules and protecting users.
After each completed lesson, families are invited to rate their instructor (1–5 stars) and leave a written review. Ratings must reflect the actual lesson experience and be submitted in good faith.
All content on the FindMySwim platform — including the app, website, logos, brand name, curriculum frameworks, skill assessment tools, the Swim Circle feature, and all related materials — is owned by FindMySwim LLC and protected by applicable intellectual property laws.
Instructors retain ownership of their own teaching methodologies and lesson plans. However, lesson notes, skill assessments, and progress reports submitted through the FindMySwim platform become part of the student's record and are maintained by FindMySwim as part of the service.
You may not reproduce, distribute, modify, or commercially exploit any FindMySwim content without express written permission.
Violations may result in immediate account suspension or termination at FindMySwim's sole discretion.
FindMySwim provides a technology marketplace platform. To the maximum extent permitted by California law, FindMySwim is not liable for:
FindMySwim's total liability for any claim is limited to the amount paid by you for the specific transaction giving rise to the claim.
You agree to defend, indemnify, and hold harmless FindMySwim LLC, its officers, members, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from:
These Terms are governed by the laws of the State of California without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of FindMySwim that cannot be resolved informally shall be submitted to binding arbitration in Los Angeles County, California, under the rules of the American Arbitration Association (AAA).
Class action lawsuits and class-wide arbitration are waived to the extent permitted by law.
FindMySwim may update these Terms at any time. When we make material changes, we will notify you by email or through the app at least 30 days before the changes take effect. Continued use of FindMySwim after the effective date of any update constitutes your acceptance of the revised Terms.
